“Tôi có cơ sở để tin rằng Cơ Quan Cảnh Sát Điều Tra Công An thành phố Hà Nội không có thẩm quyền khởi tố, điều tra hình sự đối với vụ án Đồng Tâm cũng như ban hành kết luận điều tra.”
Đó là lời Luật Sư Đặng Đình Mạnh, một trong những luật sư tham gia bào chữa trong vụ án Đồng Tâm, phân tích khi trả lời nhật báo Người Việt hôm13 Tháng Sáu, một ngày sau khi bản kết luận điều tra vụ Đồng Tâm được công bố.
“Bản kết luận điều tra là tài liệu tố tụng hình sự đầu tiên trong vụ án mà các luật sư được tiếp cận trong quá trình tham gia vụ án. Thông qua tài liệu này, chúng tôi chính thức được biết ‘tác giả’ tấn công vào tư gia ông Lê Đình Kình là đơn vị thuộc Công An thành phố Hà Nội,” Luật Sư Mạnh nói.
Vụ tấn công võ trang của nhà cầm quyền CSVN xảy ra hôm 9 Tháng Giêng, khiến ông Lê Đình Kình, “thủ lĩnh tinh thần” của người dân Đồng Tâm thiệt mạng. Và nay, 25 trong số 29 người bị truy tố với cáo buộc “Giết người,” đối mặt với bản án từ 12 năm tù đến tù chung thân hoặc tử hình. Bốn người còn lại bị truy tố với cáo buộc “Chống người thi hành công vụ,” khung hình phạt từ 2 đến 7 năm tù.

Chỉ cần giết được ba thằng là chạy hết.”
Theo luật sư, trong vụ án này, bà Dư Thị Thành, vợ ông Lê Đình Kình đã gởi đơn tố giác tội phạm giết hại chồng và một số công dân khác cũng gởi đơn tố giác tương tự. Cả hai đơn đều đặt nghi vấn lực lượng tấn công vào nhà ông Lê Đình Kình có thể là “tội phạm giết hại công dân.”
“Trong trường hợp này, rõ ràng đơn vị thuộc Công An thành phố Hà Nội cũng là đối tượng đang bị tố giác tội phạm. Theo đó, một đơn vị của Công An thành phố là Cơ Quan Cảnh Sát Điều Tra lại đứng ra khởi tố, điều tra vụ án là không thể bảo đảm sự khách quan, vô tư theo quy định tại Điều 21 Bộ Luật Tố Tụng Hình Sự,” Luật Sư Mạnh cho biết thêm.
“Thế nên, với tư cách là luật sư tham gia bào chữa trong vụ án, tôi sẽ sớm có văn bản yêu cầu chuyển hồ sơ vụ án đến Cơ Quan Cảnh Sát Điều Tra cấp trên thuộc Bộ Công An để bảo đảm sự khách quan, vô tư trong công tác điều tra vụ án cũng như bảo đảm thủ tục tố tụng,” Luật Sư Đặng Đình Mạnh nói với báo Người Việt
Ông cũng cho hay, Điều 21 Bộ Luật Tố Tụng Hình Sự CSVN ghi: “Bảo đảm sự vô tư của người có thẩm quyền tiến hành tố tụng, người tham gia tố tụng. Người có thẩm quyền tiến hành tố tụng, người phiên dịch, người dịch thuật, người giám định, người định giá tài sản, người chứng kiến không được tham gia tố tụng nếu có lý do cho rằng họ có thể không vô tư trong khi thực hiện nhiệm vụ.”
Cùng thời điểm, Luật Sư Ngô Anh Tuấn, thành viên nhóm luật sư bào chữa trong vụ án Đồng Tâm, bình luận trên trang cá nhân: “Bản kết luận điều tra nêu rõ, việc một số người (trong đó có vợ cụ Lê Đình Kình) có đơn tố cáo và đề nghị khởi tố vụ án giết người là ‘không đúng sự thật.’ Bên cạnh đó, cơ quan này cũng khẳng định một số vết thương của một số bị can như Bùi Viết Hiểu, Lê Đình Uy là ‘không xác định được cơ chế hình thành vết thương, không xác định được vật gây nên,’ nên không có cơ sở xử lý.”
Theo Luật Sư Tuấn, bản kết luận nêu trên “có rất nhiều vấn đề cần bàn cãi, cả về mặt hình thức lẫn nội dung.”
