Về mức độ nguy hiểm, nhóm tội phạm cổ cồn xanh luôn được giả định là nguy hiểm hơn nhóm tội phạm cổ cồn trắng.
Nền tảng của giả định này thường dựa vào khái niệm “Tội phạm không nạn nhân” (Victimless crime).
Trong đó, đối với nhóm tội phạm cổ cồn xanh, thường sẽ luôn có một nạn nhân cụ thể, đau thương cụ thể, tức giận cụ thể và những lời yêu cầu công lý cụ thể. Sự bất an về an toàn xã hội hiện hữu và dễ nhận biết hơn.

Về hình phạt t.hình, cần nói rõ rằng cho đến hiện nay, pháp luật Việt Nam vẫn còn duy trì án t.hình danh nghĩa đối với các tội danh và tình huống nghiêm trọng thuộc nhóm tham ô tài sản hay nhận hối lộ.

Như đã nói, tội phạm cổ cồn trắng cần quyền lực – dù là quyền lực chính trị hay quyền lực kinh tế – để có thể bắt đầu có cơ hội thực hiện hành vi của mình. Họ là những nhóm chóp bu, có đặc quyền đặc lợi nhiều nhất trong một xã hội.
Ngược lại, những tội phạm liên quan đến hành vi vũ lực hay xâm phạm thân thể/ tài sản một cách trực tiếp thường tập trung xảy ra và thực hiện bởi những nhóm yếu thế nhất, nghèo nhất và có ít quyền lực nhất trong một xã hội.
Tiếp tục cho rằng tội phạm tham nhũng hay các tội danh cổ cồn trắng đáng được bãi bỏ thực hành án t.hình, trong khi các tội danh khác thì không, sẽ tiếp tục ủng hộ cách mà hệ thống tư pháp chỉ nhìn vào “những con số” vô cùng tùy tiện như “trăm tỷ” hay “nghìn tỷ” để định tội.
