Hai Van Nguyen đã từng bị cầm tù trước đó.

Anh ấy nói rằng anh ấy đã bị giam giữ trong nhiều ngày, bị thẩm vấn và bị đánh đập – và được yêu cầu khai ra tên của những người tổ chức các cuộc biểu tình chống Trung Quốc và chống chính phủ ở Việt Nam.

Nhưng lần này thì khác. Blogger chính trị, còn được gọi là Điếu Cày, đã phải đối mặt với một phiên xử kín tại Thành phố Hồ Chí Minh vào ngày 10 tháng 9 năm 2008.

Cáo buộc chống lại anh ta là trốn thuế. Tuy nhiên, thời gian là tò mò. Anh ta bị bắt vào tháng 4 năm đó, vài ngày trước khi Ngọn đuốc Olympic được rước đến Bắc Kinh.

Việc trốn thuế, theo tổ chức phi chính phủ Human Rights Watch, là một “cái cớ” để ngăn ông biểu tình Trung Quốc. “Tôi không sợ,” Nguyễn nói qua một thông dịch viên. “Tôi biết những rủi ro.”

Bản án: có tội.

Anh ta bị kết án 2 năm rưỡi tù giam. Anh ấy nói rằng anh ấy đã phục vụ sáu.

Vào một ngày thứ Bảy gần đây, Nguyễn, 63 tuổi, ngồi trên một chiếc ghế dài trong Công viên Tự do Sid Goldstein ở Westminster.

Nguyễn nói gần như thì thầm có phương pháp về cuộc sống ở Việt Nam: chiến đấu cho miền Bắc, điều hành một cửa hàng điện tử vào những năm 1990 và tập trung vào nhân quyền.

Tổ chức Theo dõi Nhân quyền từ lâu đã chỉ trích Việt Nam là một trong những thành tích tồi tệ nhất trên thế giới, nói rằng chính phủ “đàn áp hầu như tất cả các hình thức bất đồng chính kiến.”

Nhưng ngay cả với hồ sơ nhân quyền mờ nhạt, Việt Nam và Hoa Kỳ đang ngày càng xích lại gần nhau, về mặt ngoại giao, để đối đầu với Trung Quốc về kinh tế và quân sự. Bộ Ngoại giao Hoa Kỳ gây sức ép với Việt Nam về vấn đề nhân quyền khi có thể, nhưng câu chuyện của Nguyễn nêu bật khoảng cách giữa những gì Hoa Kỳ hy vọng Việt Nam có thể trở thành và đất nước này thực sự như thế nào.

“Họ liên tục yêu cầu tôi nhận tội và họ sẽ dễ dãi với tôi,” Nguyen nói về nhiều lần bị bắt giữ. “Nhưng tôi không thể. Tôi chẳng làm gì sai cả.”

Nguyễn sinh ra ở Hải Phòng, miền bắc Việt Nam, vào năm 1952, hai năm trước khi lực lượng Cộng sản càn quét, bắt đầu cuộc nội chiến kéo dài 20 năm.

Ông là đối tượng của hai thập kỷ tuyên truyền: về sự khủng khiếp của chủ nghĩa tư bản và về sự thấp kém được cho là của các nước láng giềng phía nam.

“Mọi thứ đã đóng cửa,” Nguyen nói. “Không đài, không tivi, không giáo dục. Giáo dục của họ chỉ là để loại bỏ chủ nghĩa tư bản.”

Anh ta cũng phải tuân theo quy tắc rằng tất cả nam giới trưởng thành đều phải tham gia lực lượng vũ trang.

Từ năm 18 tuổi cho đến khi Sài Gòn sụp đổ vào ngày 30 tháng 4 năm 1975, Nguyễn đã cùng đồng đội Nam tiến.

“Tất cả những gì tôi biết là những gì họ nói với tôi,” Nguyễn nói.

Ngày Sài Gòn thất thủ, Nguyễn bắt đầu lưu trú hai tuần ở Vũng Tàu, một thị trấn cách Sài Gòn 60 dặm về phía nam.

Nguyễn nói: “Tôi thấy miền Nam đẹp biết bao. “Mắt tôi bắt đầu mở ra. Họ đã có một cách sống tốt hơn.”

Một hôm, Nguyên đang lang thang trong chợ thì nhìn thấy một phụ nữ trẻ đang làm việc ở quầy trái cây của mẹ cô. Cô ấy 18 tuổi; anh ấy 23 tuổi. Nguyễn đến gặp cô ấy và tự giới thiệu.

Cha cô là một đội trưởng trong lực lượng cảnh sát của thành phố. Trong hai tuần tiếp theo, Nguyễn đi chơi với người phụ nữ trẻ và gia đình cô, ăn tối với họ và chia sẻ những câu chuyện với họ.

“Họ lo lắng về những gì Cộng sản sẽ làm với họ,” anh nói. “Bọn họ đã sợ hãi.”

Tuy nhiên, Nguyên rất vui.

“Đó là một thời gian hấp dẫn trong cuộc đời tôi,” Nguyễn mỉm cười nói. “Mọi thứ có vẻ đẹp.”

Và rồi điện thoại của anh reo lên.

Đó là ngày 11 tháng 5 năm 1975, và cấp trên của anh ấy yêu cầu anh ấy tham gia cùng họ trong một phòng họp tại trụ sở chính. Anh biết điều đó có nghĩa là gì.

“Họ bắt tôi đi,” Nguyễn nói. “Họ bắt tôi đi vì tôi có quan hệ với con gái của đội trưởng cảnh sát.”

Trong tù, Nguyễn và các bạn tù không được phép ra ngoài, ít ăn và bị tra tấn.

Sáu tháng sau, Nguyễn được trả tự do và sau đó bị đuổi khỏi quân đội.

“Tôi đã trở lại Vũng Tàu,” anh nói. “Nhưng khi tôi đến đó, cô gái đã biến mất. Tôi chưa bao giờ nhìn thấy cô ấy một lần nữa.”

Cuối cùng Nguyễn gặp một người khác và kết hôn khi anh 31 tuổi. Anh chuyển đến Thành phố Hồ Chí Minh, học ngành điện tử và mở một cửa hàng vào đầu những năm 1990.

Tại Westminster, tại Đài tưởng niệm Chiến tranh Việt Nam, Nguyễn mô tả sự căng thẳng mà việc tham gia chính trị của anh, bắt đầu từ năm 2000, đã gây ra cuộc hôn nhân của anh. Ông và vợ ly dị vào năm 2006.

Ông có một con gái ở Canada và một con trai và con gái vẫn ở Việt Nam. Anh ấy đã không gặp họ kể từ khi anh ấy bị bắt vào năm 2008.

Trong chín tháng qua, trải nghiệm của Nguyen ở Little Saigon, nơi tập trung đông người Việt Nam nhất bên ngoài Đông Nam Á, theo nhiều cách đã giống với trải nghiệm của những người chạy trốn khỏi Việt Nam sau khi Sài Gòn sụp đổ 40 năm trước.

Nó bắt đầu vào năm 2000, với một blog.

Nguyễn đã chứng kiến cảnh nghèo đói và áp bức của đồng bào mình trong nhiều năm.

“Nếu chúng tôi không chiến đấu vì họ,” Nguyễn nói, “không ai khác sẽ chiến đấu.”

Ông Nguyễn viết về những gì ông nhìn thấy ở Việt Nam, ông nói, để mọi người trên khắp thế giới có thể nhìn thấy những vi phạm.

Anh tham gia biểu tình và chụp ảnh. Anh ấy nói rằng anh ấy đã nhìn thấy sự tàn bạo của cảnh sát. Anh ấy đã giúp thành lập Câu lạc bộ Truyền thông Tự do.

Nhóm đó bắt đầu hoạt động vào ngày 9 tháng 9 năm 2007. Và rồi công việc của anh ấy – và sự nguy hiểm – bắt đầu một cách nghiêm túc.

Nhóm này đã tổ chức nhiều cuộc biểu tình phản đối Trung Quốc, trong đó có một cuộc biểu tình vào ngày 16 tháng 12 năm 2007, trước Đại sứ quán Trung Quốc. Sau đó, Nguyễn đi bộ xuống phố về nhà. Cảnh sát đã ngăn anh ta lại.

“Tôi đã bị đánh,” Nguyen nói. “Họ bóp cổ tôi cho đến khi tôi bất tỉnh và ném tôi vào một chiếc taxi. Họ đưa tôi đến một văn phòng, đánh đập và tra khảo tôi.”

Điều đó đã không ngăn cản anh ta.

Theo Tổ chức Theo dõi Nhân quyền, anh ta đã bị bắt ít nhất 15 lần từ tháng 9 năm 2007 đến tháng 4 năm 2008, khi thời gian ngồi tù lâu nhất của anh ta bắt đầu.

Elaine Pearson, phó giám đốc phụ trách châu Á của Tổ chức Theo dõi Nhân quyền, cho biết trong một tuyên bố vào thời điểm đó: “Việc chính phủ Việt Nam đuổi một nhà hoạt động chống Trung Quốc ra đường chỉ vài ngày trước khi ngọn đuốc Thế vận hội được rước qua Thành phố Hồ Chí Minh đã đủ tệ rồi. “Nhưng để bỏ tù anh ta bây giờ với những cáo buộc đáng ngờ là một mức thấp mới.”

Anh ở tù 2,5 năm, bị nhốt trong phòng giam không có thời gian tập thể dục, bị chuyển từ nhà tù này sang nhà tù khác nên không được tiếp khách, anh tuyệt thực để phản đối việc bị giam cầm.

Trong khi đó, cảnh sát dường như nhắm mục tiêu vào gia đình anh ta.

“Họ tuyên truyền chống lại chúng tôi,” Tri Dung Nguyen, con trai 29 tuổi của Nguyen, cho biết trong một email. “Họ gọi gia đình tôi là khủng bố, phản động. Hàng xóm tránh xa. Người ta nguyền rủa mẹ tôi. … Những gì họ đang làm thật kinh tởm.”

Vào tháng 10 năm 2010, lính canh áp giải Nguyễn đến cổng nhà tù.

“Tôi mãn hạn tù và đang bước ra khỏi nhà tù,” Nguyễn nói.

“Ra cổng, tôi lại bị bắt.”

Anh ta bị buộc tội tuyên truyền chống nhà nước theo điều 88 – một lần nữa – và vào năm 2012, anh ta bị kết án 12 năm tù và 5 năm quản chế.

Các quan chức Hoa Kỳ, bao gồm cả Ngoại trưởng lúc đó là Hillary Clinton và Tổng thống Barack Obama, đã đứng ra bảo vệ ông.

“Chúng tôi lo ngại về những hạn chế đối với quyền tự do ngôn luận trực tuyến và phiên tòa sắp tới xét xử những người sáng lập cái gọi là Câu lạc bộ Nhà báo Tự do,” Clinton nói vào năm 2011 trong chuyến thăm Việt Nam.

Anh Nguyễn cho biết các đảng viên Đảng Cộng sản tiếp tục chuyển anh đi khắp nơi, hết nhà tù này đến nhà tù khác, vì vậy gia đình anh không thể tìm thấy anh. Họ đánh anh ta và thúc giục anh ta thừa nhận hành vi phạm tội, anh ta nói.

Ông tiếp tục tuyệt thực, thậm chí có lần phải nhập viện.

Rồi một ngày, anh ta được trả tự do – đại loại thế.

Vào ngày 21 tháng 10, ngay sau khi Hoa Kỳ nới lỏng lệnh cấm vận vũ khí đối với Việt Nam, các nhân viên an ninh đã đưa ông ra khỏi nhà tù và đưa ông lên xe đưa đón.

“Tôi được đưa thẳng đến sân bay,” Nguyễn nói. “Tôi được đưa lên máy bay và gửi đến Hoa Kỳ. Tôi không có lựa chọn nào khác.”

Anh đặt chân đến Mỹ, được chính phủ Hoa Kỳ cho phép tị nạn và chuyển đến Westminster để bắt đầu cuộc sống mới.

Nguyên vẫn chưa thấy người nhà của mình ở Việt Nam. “Họ không cho tôi,” anh nói.

Anh ấy nói rằng anh ấy lo lắng cho gia đình mình và những gì chính quyền Hà Nội có thể làm vì hoạt động của anh ấy. Nhưng, Nguyen nói, đó là một cái giá cần thiết để đấu tranh cho những gì anh ấy tin tưởng.

“Mọi người đều có lựa chọn của riêng mình trong cuộc sống,” Nguyên nói. “Tôi đã chọn làm theo trái tim và lương tâm của mình, và đấu tranh cho tự do.

“Tôi sẽ làm lại từ đầu,” anh nói.

Hai Van Nguyen had been imprisoned before.

He’d been held for days, he says, interrogated and beaten – and told to give up the names of those organizing anti-China and anti-government protests in Vietnam.

But this time was different. The political blogger, also known as Dieu Cay, faced a closed-door trial in Ho Chi Minh City on Sept. 10, 2008.

The charge against him was tax evasion. Yet the timing was curious. He was arrested that April, days before the Olympic Torch came through on its way to Beijing.

Tax evasion, according to nongovernmental organization Human Rights Watch, was a “pretext” to keep him from protesting China. “I wasn’t scared,” Nguyen said through an interpreter. “I knew the risks.”

The verdict: guilty.

He was sentenced to 2 1/2 years in prison. He says he served six.

On a recent Saturday, Nguyen, 63, sat on a bench in Sid Goldstein Freedom Park in Westminster.

Nguyen spoke in a methodical near-whisper about life in Vietnam: fighting for the North, running an electronics shop in the 1990s and turning his focus toward human rights.

Human Rights Watch long has decried Vietnam as having one of the worst records in the world, saying the government “suppresses virtually all forms of political dissent.”

But even with the porous human rights record, Vietnam and the United States are increasingly coming together, diplomatically, to confront China economically and militarily. The U.S. State Department presses Vietnam on human rights when it can, but Nguyen’s story highlights the chasm between what America hopes Vietnam can become and what the country is actually like.

“They kept asking me to admit to a crime and they would go easy on me,” Nguyen said of his multiple arrests. “But I couldn’t. I did nothing wrong.”

Nguyen was born in Hai Phong, in northern Vietnam, in 1952, two years before Communist forces swept through, starting the 20-year civil war.

He was subjected to two decades of propaganda: about the horrors of capitalism and about the supposed inferiority of his southern neighbors.

“Everything is closed,” Nguyen said. “No radio, no TV, no education. Their education is only to eliminate capitalism.”

He was also subject to the rule that all adult males join the armed forces.

From the time he was 18 until Saigon fell on April 30, 1975, Nguyen pushed southward with his comrades.

“All I knew was what they told me,” Nguyen said.

The day Saigon fell, Nguyen began a two-week stay in Vung Tau, a town about 60 miles south of Saigon.

“I saw how beautiful the South was,” Nguyen said. “My eyes began to open. They had a better way of living.”

One day, Nguyen was wandering through a market when he saw a young woman working at her mother’s fruit stand. She was 18; he was 23. Nguyen went up to her and introduced himself.

Her father was a captain in the city’s police force. For the next two weeks, Nguyen hung out with the young woman and her family, having dinner with them and sharing stories with them.

“They were worried about what the Communists would do to them,” he said. “They were scared.”

Nguyen, though, was happy.

“It was an attractive time in my life,” Nguyen said, smiling. “Everything seemed beautiful.”

And then his phone rang.

It was May 11, 1975, and his superiors asked him to join them in a meeting room at headquarters. He knew what that meant.

“They took me away,” Nguyen said. “They took me away because I had a relationship with the daughter of the police captain.”

In jail, Nguyen and his fellow inmates weren’t allowed outside, had little to eat and were tortured.

Six months later, Nguyen was released and subsequently kicked out of thearmy.

“I went back to Vung Tau,” he said. “But when I got there, the girl was gone. I never saw her again.”

Nguyen eventually met someone else and married when he was 31. He moved to Ho Chi Minh City, studied electronics and opened a shop in the early 1990s.

In Westminster, at the Vietnam War Memorial, Nguyen described the tension his political involvement, beginning in 2000, caused his marriage. He and his wife divorced in 2006.

He has one daughter in Canada and a son and daughter still in Vietnam. He hasn’t seen them since he was arrested in 2008.

In the past nine months, Nguyen’s experience in Little Saigon, which has the largest concentration of Vietnamese outside of Southeast Asia, in many ways has paralleled the experiences of those who fled Vietnam after Saigon fell 40 years ago.

He is living with friends and trying to build a new life while staying connected to what is going on in his homeland.

He speaks to the Vietnamese American media about the situation back home – balancing anger against the Communist government with railing against Beijing’s aggressiveness in the South China Sea.

“I don’t have a job,” he said. “But I am still trying to focus on human rights in Vietnam.”

It started in 2000, with a blog.

Nguyen witnessed for years the poverty and oppression of his fellow citizens.

“If we don’t fight for them,” Nguyen said, “no one else will.”

Nguyen wrote about what he saw in Vietnam, he said, so people around the world could see the violations.

He joined protests and took photos. He said he saw police brutality. He helped found The Freedom Media Club.

That group began its work Sept. 9, 2007. And then his work – and danger – began in earnest.

The group staged several protests against China, including one Dec. 16, 2007, in front of the Chinese Embassy. Afterward, Nguyen walked down the street toward his home. The police stopped him.

“I was beat up,” Nguyen said. “They choked me until I passed out and threw me in a taxi. They took me to an office and beat and interrogated me.”

That didn’t stop him.

There were protests throughout December and into the new year.

“They asked me who organized the protests,” Nguyen said. “They eventually realized that I was one of the organizers.”

He was arrested, according to Human Rights Watch, at least 15 times fromSeptember 2007 to April 2008, when his longest stint in prison began.

“It’s bad enough that the Vietnamese government took an anti-China activist off the street only days before the Olympics torch passed through Ho Chi Minh City,” Elaine Pearson, deputy Asia director at Human Rights Watch, said in a statement at the time. “But to imprison him now on questionable charges is a new low.”

He spent 21/2 years in prison, stuck in his cell without exercise time, being moved from prison to prison so he couldn’t receive visitors, undertaking hunger strikes to protest his imprisonment.

Meanwhile, police apparently targeted his family.

“They used propaganda against us,” said Tri Dung Nguyen, Nguyen’s 29-year-old son, in an email. “They called my family terrorists and reactionaries. Neighbors stayed away. People cursed my mom. … What they are doing is disgusting.”

In October 2010, guards escorted Nguyen to the gate of the prison.

“I served my time and was walking out of the prison,” Nguyen said.

“At the gate, I was arrested again.”

He was charged with tax evasion – again – and, in 2012, was sentenced to 12 years in prison and five years’ probation.

U.S. officials, including then-Secretary of State Hillary Clinton and President Barack Obama, came to his defense.

“We are concerned about restrictions on free expression online and the upcoming trial of the founders of the so-called Free Journalists Club,” Clinton said in 2011 during a visit to Vietnam.

Nguyen said Communist Party members continued to move him around, prison to prison, so his family couldn’t find him. They beat him up and urged him to admit to criminal activity, he said.

He continued his hunger strikes, even being hospitalized once.

Then one day, he was freed – sort of.

On Oct. 21, shortly after the United States eased an arms embargo on Vietnam, security guards removed him from his prison and put him on a shuttle.

“I was taken straight to the airport,” Nguyen said. “I was put on a plane and sent to the United States. I didn’t have a choice.”

He landed in America, was granted asylum by the U.S. government and moved to Westminster to start his new life.

Nguyen still hasn’t seen his family members in Vietnam. “They wouldn’t let me,” he said.

He says he does worry about his family and what the Hanoi government may do it because of his activism. But, Nguyen said, it is a necessary cost of fighting for what he believes in.

“Everyone has his own choices in life,” Nguyen said. “I chose to follow my heart and conscience, and fight for freedom.

“I would do it all over again,” he said.
