QĐ225 yêu cầu BQLRĐ tuân theo quy định về cấp giấy chứng nhận QSDĐ của Tổng cục quản lý ruộng đất, tức QĐ201.
Sau khi xem xét các quyết định nêu trên, tôi khẳng định QĐ07 do Trưởng BQLRĐ cấp cho Bưu điện TPHCM là trái pháp luật, vô giá trị, thực chất là tờ giấy lộn, vì:
1/ Giấy này không theo mẫu của Tổng cục Quản lý Ruộng đất được quy định tại mục V của QĐ201, theo đó (i) giấy phải do Tổng cục này phát hành, (ii) trang 1 có ghi số giấy và dấu của Tổng cục QLRĐ, (iii)trang 2 ghi thời hạn sử dụng, (iv) chữ ký của chủ tịch UBND cấp tỉnh hay cấp quận, huyện. Thế nhưng QĐ07 không đáp ứng cả 4 tiêu chí này, chỉ là giấy lộn!
2/ Giấy này mang tiêu đề “Quyết định công nhận quyền sử dụng đất”, trong khi theo pháp luật đất đai tại thời điểm cấp (1991) không có loại giấy tờ này. Giấy này trái pháp luật.
3/ QĐ 201 (và cũng như bất cứ văn bản quy phạm pháp luật nào khác về đất đai có hiệu lực tại thời điểm 1991) không cho phép Trưởng BQLRĐ được uỷ quyển ký thay UBND cấp tỉnh cấp giấy chứng nhận QSDĐ, tức QĐ 225 của UBND TPHCM là trái pháp luật về đất đai, việc uỷ quyền này là vô hiệu nên QĐ07 không có giá trị.
4/ Mặt khác QĐ225 chỉ uỷ quyền cho trưởng BQLRĐ cấp giấy chứng nhận QSDĐ cho người sử dụng đất, không uỷ quyền cho ban hành Quyết định công nhận QSDĐ, lại cấp cho người không sử dụng đất (phần 2,08 ha, người dân VRLH đang sử dụng trồng rau). Như vậy trưởng BQLRĐ đã lạm quyền, vượt quá uỷ quyền khi ký QĐ07, do đó QĐ07 vô giá trị, ít nhất phần 2,08 ha đất VRLH.
