Theo báo Thanh Niên, Viện KSND tối cao vừa kháng nghị giám đốc thẩm, đề nghị Hội đồng thẩm phán (HĐTP) TAND tối cao xét xử thủ tục giám đốc thẩm, hủy toàn bộ Bản án sơ thẩm năm 2008 của TAND tỉnh Long An và Bản án phúc thẩm năm 2009 của Tòa phúc thẩm TAND tối cao tại TP.HCM đã xét xử bị án Hồ Duy Hải tử hình về tội “giết người”, “cướp tài sản”, để điều tra lại theo đúng quy định của pháp luật.
Vụ án giết hai nữ nhân viên bưu điện tại tỉnh Long An cách đây gần 12 năm, trong đó thủ phạm được xác định là Hồ Duy Hải, bị kêu án tử hình ở cấp sơ thẩm và phúc thẩm, dù Hải kêu oan và hiện người mẹ của tử tù này đang đi khắp nơi theo bà là đòi công lý cho con, vì con bà đang là “vật thế mạng” cho một ai đó!
Hồ Duy Hải đã ở tù oan hơn 11 năm, thay cho “một ai đó” bởi anh ta đã bị “suy đoán có tội” chỉ dựa trên lời khai và “thú tội” (ban đầu anh Hải kêu oan nhưng sau… nhận tội và lại kêu oan!!!).
Các vật chứng thì bên điều tra đã sai phạm nghiêm trọng khi “cắt” một con dao đi mua cho “đúng kích thước” con dao mô tả, ra chợ mua thêm một cái thớt để đủ vật chứng (Hải được cho là dùng thớt đập đầu nạn nhân), và bỏ qua những vật chứng quan trọng như vết máu, đặc biệt dấu tay tại hiện trường được pháp y xác nhận không phải dấu tay của Hải.
Hồ Duy Hải suýt bị tử hình năm 2014 nếu không có bà mẹ tuyên bố tự thiêu tại Hà Nội nếu con bị thi hành án. Đây không hề là “vụ án phức tạp” như nhiều báo cáo, quan chức nhận định mà là do người ta muốn anh Hải làm kẻ thế thân.
Có bao nhiêu vụ án oan sai tại VN? Chúng ta không thể biết hết nhưng khi nào tòa án không được xét xử độc lập thì điều này vẫn luôn xảy ra.
