Hồ Tấn Minh – Chánh Văn phòng Sở GD&ĐT TP.HCM, dùng Thông tư 16 để bênh vực hành vi chiếm đoạt tài sản của Trường Tiểu học Hồng Hà – khi sử dụng tiền thu của phụ huynh vào đầu năm học, để chi 227 triệu đồng sửa chữa phòng học của lớp 1/2 (5,67 triệu đồng/sàn m2) bằng giá thành xây mới một mét vuông sàn biệt thự!
Hồ Tấn Minh thừa nhận, Thông tư 55 của Bộ GD&ĐT quy định “ban đại diện cha mẹ học sinh không được quyên góp mua sắm máy móc, trang thiết bị, đồ dùng dạy học; sửa chữa, nâng cấp các công trình của nhà trường“. Nghĩa là, máy móc, trang thiết bị dạy học không có, hoặc phòng học xuống cấp thì kệ nhà trường. Vì ngân sách cấp kinh phí xây dựng, sửa chữa phòng học và mua trang thiết bị dạy học, nhưng các trường vẫn lạm thu, nên Bộ cấm “đích danh” ban đại diện cha mẹ HS không được quyên góp!
Hô Tấn Minh đem Thông tư 16/2018 “QUY ĐỊNH VỀ TÀI TRỢ CHO CÁC CƠ SỞ GIÁO DỤC THUỘC HỆ THỐNG GIÁO DỤC QUỐC DÂN” bào chữa “việc phụ huynh tự nguyện đóng góp, tài trợ để sửa chữa phòng học là không sai”. Nhưng, “tự nguyện đóng góp” chỉ là một mục nhỏ nằm trong 6 nguyên tắc vận động, tiếp nhận, quản lý và sử dụng tài trợ, được quy định tại Điều 2 Thông tư 16.
Hồ Tấn Minh nên nhớ, việc quyên góp 313 triệu đồng rồi đem 227 triệu sửa chữa phòng học ĐÃ KHÔNG công bố, niêm yết công khai tại TRƯỜNG HỒNG HÀ và tuân thủ đúng quy định của pháp luật hiện hành, theo khoản 2, điều 2, Thông tư 16! Trường đã không niêm yết công khai việc thuê đơn vị kiểm định xây dựng khảo sát sự xuống cấp của phòng học, thống kê các hạng mục sửa chữa, giá thành đấu thầu sửa chữa các hạng mục… nên không phải là VẬN ĐỘNG TÀI TRỢ!
Khoản 1, điều 2: “Việc tài trợ phải đảm bảo nguyên tắc tự nguyện, công khai, minh bạch, không ép buộc không quy định mức tài trợ bình quân, không quy định mức tài trợ tối thiểu”. Nhưng mỗi phụ huynh lớp 1/2 đều đóng “10 triệu đồng” thì “tự nguyện cái quần què” hả Minh?
Khoản 1 cũng quy định “không lợi dụng việc tài trợ cho giáo dục để ép buộc đóng góp và không coi huy động tài trợ là điều kiện cho việc cung cấp dịch vụ giáo dục, đào tạo”. Nhưng Hồ Tấn Minh không đưa ra bằng chứng cô giáo chủ nhiệm lớp 1/2 không nói việc sửa chữa phòng học 227 triệu là để cho các em học tiện nghi hơn là để nó xuống cấp!
Xin nhắc Hồ Tấn Minh biết, chỉ có Quốc hội mới ban hành mức thuế và phí cho cả nước; chỉ có HĐND tỉnh mới được quyền quy định các khoản thu của các đơn vị công lập trong tỉnh. Vì vậy, tất cả các trường công lập ở TPHCM chỉ được thu đúng 26 khoản đã quy định tại Phụ lục kèm NGHỊ QUYẾT 04/2023/NQ-HĐND TPHCM ngày 12/7/2023 (QUY ĐỊNH CÁC KHOẢN THU VÀ MỨC THU, CƠ CHẾ QUẢN LÝ THU CHI ĐỐI VỚI CÁC DỊCH VỤ PHỤC VỤ, HỖ TRỢ HOẠT ĐỘNG GIÁO DỤC CỦA CƠ SỞ GIÁO DỤC CÔNG LẬP TRÊN ĐỊA BÀN THÀNH PHỐ HỒ CHÍ MINH NĂM HỌC 2023-2024).
Trong 26 khoản thu này, không có “Thu sửa chữa phòng học”. Một lần nữa, tôi đề nghị khởi tố Hiệu trưởng Trường Tiểu học Hồng Hà, vì đã xem nghị quyết như tờ giấy lộn, dù mới ban hành chưa ráo mực!
Không có đại biểu HĐND TPHCM nào lên tiếng về việc thu ngoài quy định của Nghị quyết 04, giống như các vị là những người bù nhìn!
